Estate planning is the process of preparing the necessary documents to ensure that your assets are distributed to your beneficiaries according to your directions. Probate is a judicial process administered by a probate court. If the deceased person left a will, the probate court will determine if the will is valid. If the will is valid, the court will ensure that instructions found within the will are carried out properly. If there is no will, the court will distribute the assets of the deceased person’s estate according to state law. Completing the probate process, known as “settling the estate”, must be done extremely carefully to avoid errors and must be completed within the time period specified by the court.
